As far as I know, yes it is...I remember doing H1 myself few years ago and the LCA form has prevailing wage rate section. As we know, the wage rates differ from place to place and so since H1 is based on prevailing wage rate on LCA, then H1 is also location specific. Even though LCA form has been changed since then, I think it still holds true...
I am sure that per law or whatever when you filed for a h1b for a location A and the petitioner moves to a location B, then I believe you have to file an amendment for ur h1b to that new location...the question is Iam not sure how many people care to do that

I am not so sure....OP might have followed the law to the letter but what if one of his employers did not ? As UN is repeatedly pointing out (with his CSC I140 example), OP has to contact a good attorney before replying to the request lest his app will be in peril as the contracts will suggest that the position is temporary. Being naive and hoping for the best without considering all the options by OP in my view is fraught with risks. Anyways, good luck to him.

No need to have Durbin's bill. Just ban Outsourcing, then all jobs will come back and everybody will be happy here in US.
US congress cannot force investors to invest money only in US and get work done only in US.
Its not possible for US Government to ban outsourcing. The only thing they can do is create incentives to limit outsourcing. However, if a company still wants to outsource jobs overseas, Congress cant do ANYTHING about it.

I have full sympathy for anyone that has not broken any laws including OP and 'leoindiano". If I had the powers to approve green cards, I would give them away to him and his brother!
The problem here is no one (consulting company/employee) bothered to make sure that a person on H-1B was allowed to do consulting. I'm not sure who dropped the ball - companies, employees, or the immigration lawyers. But someone should have raised a flag when the type of job was really a temp job. Unfortunately that did not happen.
Now that the damage has been done, and USCIS is coming after such folks, they are upset that it is happening to them. Again, do note that I am not saying the consultants themselves are less skilled than anyone with FT job. I'm just saying that at the time they got into consulting they did not think of the various consequences. Maybe because no one ever thought that working at different locations, benching, temp nature of the jobs were all against H-1B visa rules?

What are you options if your GC is denied because the company declared bankruptcy? How do you justify to yourself staying with the employer when they files you under Eb3 category when you a master's degree holder from one of the 10 best universities in the US? What are the employee choices here, just pack up and leave? leave houses, friends and people you stayed with many years.
You think they haven't searched for full time positions with other companies only to be turned back? or worse case restart the entire GC process and forgo the 6+ years?
And the experiences I am relating are from the 2001 recession. I have changed the H1b after my last entry to usa. My I-94 in passport and in the H1b approval notice numbers are not same. Out of all 10 digits only 6th digit is different. I think it is a typo by uscis. What should I do?? The difference is very hard to figure out that I noticed it only when I was filling out I-485 by myself.

You can file Form I 102 with USCIS , if it is the mistake of USCIS there is no charge. If I 94 is mutilated,lost or stolen then u have to pay a fee for it.

don't think the rent will be much lower than paying the mortgage, it is true atleast in the city where I live. For example: If I am paying a mortgage of $1200 and the rental of an equivalent is $ 900, the $300 difference you get back in tax refund at the end of the year. So why pay rent when I can buy a house and do whatever I want to with it ?
Where I live, the median house price is 200,000. I bought a house which is lower than the median and when the market was on the downward trend (september 2006). If you look at the post I quoted, you would notice that I am not subscribing to the crazies who bought houses with the example dollar amounts you gave. If you know your limits and do 2 hours of internet research, then the person probably will make a much better decision. The information and warning signs were there everywhere starting 2005, if people chose to ignore and got burned then shame on them.

As you already know that anti-H1B lobby has introduced a bill that is designed to put most H-1B dependent employers out of business and most H-1B employees out of the country. This bill is designed to slow bleed H-1B program and systematically purge H-1B employees from the country.

1. Renew your H1 at the same company by filing an extension,
2. Transfer your H1 to another company by filing a transfer or
3. File a brand-new cap-subject H1 for someone who has never been on H1.
ALL OF THE 3 WILL BE AFFECTED.
For all 3, you have to file the same form I-129 and you get the same 2 forms in return from USCIS : I-797 (and I-94 too unless its an H1 for someone outside USA).
The first 2 ways are cap exempt, and the last one (brand new) H1 is cap subject.
But the process is the same. Paperwork is the same. AC21 tells that one can leave the job after 6 months of filing I485. But the green card is for future job and if anyone is not working for a company after receiving permanent job then green card can be considered as fraud.
These 2 rules are contraditory in nature.
Some of my friends quit the job after 6 months of I485 but after receiving GC they went back and worked for a few months.
Generally USCIS does not have time and resource to track this. But I think they do randomly. One of my other friend resigned the job and he was doing business. He got interview and he postponed the interview to get a job and letter from his previous Company.
If anyone is happy in their job can stay there till receiving gc. In case of layoffs there is no choice one need to invoke. Even if need to resign the Company it is better try to maintain good relationship. After 8 years GC is denied that will place in tough situation though it will happen for a few cases

This whole GC process is unpredictable. Don't waste ur life for it. Do whatever u think is best for you. It will be America on the loosing side if they deny u the GC after u have bought the home.
it is not just america losing - the person who has bought the house would lose his downpayment / equity too -not to speak of the mighty credit score - am I right ??
depends on yr situation and your priorities and more important the place where you are planning to buy. is it in florida, mich, Ohio, california or nevada (I guess no - else you would not have asked this question). if you think of a house as investment and you dont want to take a loss - then wait. if you need the space desperately and you are o.k with the prospect of yr house depreciating for couple of years - then go ahead and buy. Sadly, people don't see through his tactics. His name was not on any ballot, and inspite of the Dem victory, he will continue to enjoy the prime slot on CNN. Of course, it was his news telecast that drove millions of Hispanics to the elections.
And yet, I don't think it is wise to ignore him. His news telecast was an inspirational force for numbersusa who were behind killing SKIL. He will continue on CNN, and will have some power.

Economists and western political leaders love to compare India and China, and it�s an understandably irresistible comparison: They�re both rising Asian economies with more than a billion people, and neighbors to boot.
On India Real Time we�ve done a little of that ourselves from time to time.
If you�re pressed for time we can sum it up like this: China has more of everything (except poor people.) If you�re not, here are five blogs that stacked India and China up against each other on different indicators in the past year.
Warren Buffett: The billionaire from Omaha so far has appeared to be leaning a bit more towards China, at least in terms of investments. Mr. Buffett�s company, Berkshire Hathaway Co., holds a sizeable stake in Chinese battery and auto-maker BYD Co. And Mr. Buffett visited in September, along with Bill Gates, hoping to convince Chinese billionaires to give away more of their wealth to charity. The love is returned, with a Chinese man having paid a record $2.1 million to have a one-on-one lunch with the investing wizard.
Mr. Buffett has said that he�d like to invest in India but his plans have been stymied by caps on foreign holdings in insurance.
However, India can at least look forward to hosting him in the new year. The billionaire announced at a shareholders� meeting this year, in response to a question from a young Indian-American, that he plans to visit India in 2011, perhaps in March.
The big-ticket event: India hosted the Commonwealth Games in October, China hosted the Asian Games in November. Of course, China�s already hosted the Olympics�and how�so it hardly seems fair to compare the two.
But we did anyway. The news coverage of the Indian Games was rife with words like �delays,� �corruption,� �shambles� (we�re pretty sure that was the British press) and �filthy� until the opening night extravaganza quelled criticism for a bit.
China, it appeared, had lovely, shiny venues ready to go about five months ahead of the event, so it could spend the final days flicking away little specks of dust from its Games merchandise.
Their middle classes: According to a report on Asia�s middle classes this year, India still has about 650 million people living on under $2 dollars a day measured in 2005 purchasing parity dollars.
China now has less than 100 million living on that amount. Yet there was a time, as recently as the 1990s, when the two countries had similar numbers of poor. China has just done a better job of lifting people from that bracket into the middle class, and not just onto the next rung �the $2 to $4 range, where a majority of India�s middle class folks fall.
The majority of Chinese now fall in the �mid middle class� category that can spend $5 to $10, a group whose numbers appear to have quadrupled between 1995 and 2007.
But don�t blame the slower rate of reduction in poverty on India�s political system, says John Lee of the Sydney-based think-tank Center for Independent Studies.
The economy, stupid: China is still a much bigger economy than India, even though the two countries have roughly similar numbers of people. At a Hindustan Times conference on India, Shashi Ruia, chairman of Essar Group, compared the two countries on steel production, car production and trade.
As we already said, China does more of everything. The gap is undoubtedly glaring on roads, electricity production, trains and other infrastructure.
Surfing: India�s and China�s online populations belong to different worlds, judging by their Google searches. India appears to be firmly embedded in the English-speaking western world, looking for products like Nokia and applications like Facebook, Yahoo! and YouTube, although when it comes to films, it�s all Bollywood. China seemed to be the reverse�relying largely on Chinese applications but much more likely to seek out Hollywood films. They did have this much in common though: outr� pop star Lady Gaga.

If you want to buy a home after you get your green card, mostly you will get after your retirement.
I don't want to feel "my home" when I am 68 and after my kids are out on their own. So I decided, dump the H1B, H4, 485, 131, 761, 797, 999, 888, I94, EAD, AP... AAD, CCD etc crap in trash, and bought the home.
I am happy. Even if I am asked to leave the country tomorrow, I just lock the door, throw the keys in trash and take off.
Who cares when life matters.

When there is no solution is to be found for the illegal immigration issue...then the obvious thing to mess with is the legal immigration! Isn't It? ;)

Corporate world drives the laws and lobbying. This bill will be in the bin even before you know it. As for the STIVE etc. none will make it as long as they are comprehensive in nature. That said, the relief to the EB segment is coming soon, so sit tight.
