I remember reading if you travel outside the country while your AP is pending, it will be considered abandoned and you may not receive approval or any refund.

Friends,
Our (Me / Spouse / Kid) I-485 is pending approval and our priority date is May 2007 EB2 India. I am planning to send my spouse and Kid to India for kid education. I do not want to cancel their I-485. They may stay in India till I get my GC :=) ( I dont know when)..
Initially I thought of bringing them to US every year to renew the AP. But It is expensive for me and I am thinking it is not a wise idea.
I am thinking of applying the Consular processing only to Spouse and Kid in India. They are dependants to me. I am the primary applicant. Is it possible/allowed to apply consular processing only for dependants and keep the Primary applicant in AOS

"Oversight" is correct as Visa Office was responding to House Committee that has oversight function for immigration.

I had to go through the same process last year. The day i went for the interview, there were 3 other PhDs with me to get their H1B stamped. It took me 7 weeks to get the passport back and for others it took longer. Calling embassy will not expedite the process. Call Department of State and ask for the update. I know its frustrating.

I got my GC last year... My wifes PD is the same as mine which is Sept 2003... She has been current for a while... 2 infopass and several SRs... no luck yet!

QUESTION::
Can we use automatic revalidation to enter USA without getting our visa's stamped. My h1 expired in 2006 and my spouse�s H4 expired in 2006.
(Remember my spouse is applying for H1 )
ANSWER:: No, with Canadian GC you can not enter USA for long term work, without stamping. I think entry for one month is permitted.
QUESTION:: How safe it is Frequent travel to Canada and back
ANSWER:: It is safe to cross US and Canada border, if you have multiple entry visa.
QUESTION:: How safe it is to stay in Canada for duration of 3-6 months and come back to USA
ANSWER:: As long as you are in H1 B there is no restriction. In future if you enter I-485, there are complications, if you continue to travel back and forth at that time too.
QUESTION:: Once my spouse gets the H1 approved, should he move to H1 immediately or can continue on H4?
ANSWER:: Once the H1 is approved and if the new I-94 is attached at the bottom of the H1 approval, then it means the status from H4 to H1 is transferred. If there is no I-94 then the status will get transferred while you get the visa stamping.

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.

- Secondly, I am confused what to explain for Part 7 of I-131 form that states : "On a seperate sheet of paper, Explain how you qualify for an advance parole document and what circumstances warrant issuance of advance parole"

Hi guys, I have a unique situation, thanks to july visa bulletin. I have a EB3 labor and I 140 approved with the PD as May 2004. Recently I applied EB2 PERM in order to port the PD from EB3 to EB2. My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.
I suggest go with EB2 if the priority date is way ahead of EB3
